Welcome to The Football Whisperer. These Terms of Use ("Terms") are a binding agreement between you and The Football Whisperer ("we," "us," or "our") and govern your access to and use of our website, content, newsletters, memberships, merchandise, and related services (together, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are

The Football Whisperer is an independent, personality-driven football publication covering college and professional football through opinion, analysis, predictions, and commentary. The Service is operated by the entity behind The Football Whisperer brand (the "Operator"). References to "we" and "us" mean the Operator.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account, purchase a membership or merchandise, or otherwise transact with us. By using the Service you represent that you meet these requirements and that any information you provide is accurate.

3. Picks, Predictions, and No Betting Advice

All picks, score predictions, "locks," "upsets," rankings, and related commentary are provided for informational and entertainment purposes only. They reflect the personal opinions of The Football Whisperer and are not guarantees of any outcome. We are not a sportsbook, we do not accept wagers, and nothing on the Service is gambling, betting, investment, or financial advice. Any decisions you make — including any wager you choose to place with a third party — are made solely at your own risk, and you are responsible for complying with all laws that apply to you, including any laws regarding sports wagering in your jurisdiction. 4. Accounts and Membership

Certain features — such as The Whisperer Nation membership and The Audible newsletter — may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, Billing, and Auto-Renewal

Paid memberships and subscriptions, where offered, are billed in advance on a recurring basis (for example, monthly or annually) through our third-party payment processor. Unless you cancel before the end of the current billing period, your subscription will automatically renew and the applicable fee will be charged to your payment method. You may cancel at any time through your account or by contacting us; cancellation takes effect at the end of the current billing period. Fees may change with prior notice. Refunds, where available, are governed by our Refund Policy.

6. Merchandise Purchases

Merchandise offered through Official Football Whisperer Wear is sold subject to the product descriptions, pricing, and availability shown at the time of purchase. Some items may be produced on demand by third-party fulfillment partners. Title and risk of loss pass to you upon delivery to the carrier. Returns and refunds are governed by our Refund Policy.

7. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) copy, scrape, republish, or redistribute our content without permission; (c) attempt to gain unauthorized access to the Service or interfere with its operation; (d) upload malicious code; (e) impersonate any person or misrepresent your affiliation; or (f) use the Service to harass, abuse, or harm others.

8. Intellectual Property

All content on the Service — including articles, predictions, logos, graphics, the "The Football Whisperer" name and brand, and the selection and arrangement of content — is owned by or licensed to us and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to access and view the content for your personal, non-commercial use. All rights not expressly granted are reserved.

9. User Submissions

If the Service allows you to submit content (such as comments, messages, or feedback), you retain ownership of your submission but grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, and display it in connection with the Service. You are responsible for your submissions and represent that they are not unlawful, infringing, or offensive. We may remove any submission at our discretion.

10. Third-Party Content and Links

The Service may display data, scores, schedules, statistics, and links from third parties. We do not control and are not responsible for third-party content, websites, or services, and their inclusion does not imply endorsement. Team names, logos, and marks referenced on the Service are the property of their respective owners and are used for identification and commentary purposes.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any prediction or information will be accurate or reliable.

12. Limitation of Liability

To the fullest extent permitted by law, we and our owners, contributors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (USD 100).

13. Indemnification

You agree to indemnify and hold harmless The Football Whisperer and its owners, contributors, and partners from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.

14. Changes to the Service and Terms

We may modify or discontinue any part of the Service at any time. We may also update these Terms from time to time; the "Last updated" date reflects the most recent changes. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in the State of Texas for any dispute arising out of these Terms or the Service.
